I was a pedestrian and was hit by a car, what benefits am I entitled to?

A pedestrian accident can be a catastrophic situation. With no protection, the victim is helpless during impact and the injuries can be severe.

There are a number of rights and benefits for Ontario pedestrian accident victims if a motor vehicle, such as a car or truck, are involved. These benefits are called No-Fault benefits.

No-Fault benefits are available to pedestrian accident victims involving a motor vehicle, such as a car or truck. Even if you don't own a car, as long as the car or truck was involved in causing the accident, you can obtain No-Fault benefits.

Typically, in a pedestrian accident the payment of No-Fault benefits comes from your own auto insurance company. However, if is important to get the other person's auto insurance information at the accident scene. You should also report any injuries to the police and medical personnel at the accident scene.

No-fault benefits, depending on the severity of your injuries, may cover payment of medical and rehabilitation therapies and payment for prescription drugs. No-fault benefits also include income replacement benefits paid at 70% of your gross income if you have suffered a substantial inability to perform the essential tasks of your regular employment. If you are proven catastrophically impaired, you could be entitled to housekeeping/home maintenance benefits, caregiver benefits, and increased limits to the medical and rehabilitation benefits.

In addition, if the accident was the fault of another person, you can make a claim for pain and suffering damages. This is a called a third-party or tort claim. Compensation for pain and suffering typically comes from the at-fault driver's insurance company.

Be aware that there is a deductible of $30,000.00 whereby your injuries must be worth more than this amount to pass the threshold.
