ONTARIO NO-FAULT CLAIMS
Every auto insurance policy in Ontario is a no-fault policy and contains the right to receive no-fault benefits. A person is entitled to no-fault benefits even if they caused the accident, so long as the person was involved in a motor vehicle accident.
Passengers, pedestrians, bicyclists and drivers are examples of people entitled to Ontario no-fault benefits. It is important to understand that just because you do not personally have car insurance, or don't own a car, does not mean you can't receive benefits. Even without car insurance, in almost all situations you are still entitled to no-fault benefits.
As of September 1, 2010, much of your benefits have changed depending on the severity of your injuries. You are still entitled to wage loss or income replacement benefits which are paid at 70% of your gross weekly income up to a maximum of $400.00 per week unless you obtained optional benefits. To receive no-fault benefits, you must first contact your insurance company within 7 days of the date of the accident and request an Application for Accident Benefits form. You must complete this form and return it to the insurance company within 30 days. If you fail to do so, you may not be entitled to receive benefits.
